Connecticut’s Ignition Interlock Device Law

However, things have become more complicated in recent years. Many states now require the use of ignition interlock devices (IIDs) for repeat offenders, adding a new layer of responsibility and restriction.

Connecticut was one of the first states to introduce an IID law in 2015. The law requires drivers with a second or subsequent OUI (Operating Under the Influence) offense to install an IID in their vehicles. Since then, the state has expanded the requirement so that anyone who has had their license suspended due to such offenses must use an IID for a set period of time before they can regain full driving privileges.

What Is an Ignition Interlock Device?

An ignition interlock device is installed in a vehicle after a DUI or OUI offense. It works by requiring the driver to blow into the device before starting the engine. If the device detects a blood alcohol concentration (BAC) above a certain limit — typically .025% — the car won’t start. This helps prevent individuals from driving while intoxicated.

But the device doesn’t just check your BAC once. During your drive, the IID may randomly prompt you for a “rolling retest” to ensure you’re not under the influence while on the road. These checks are crucial for maintaining compliance and ensuring public safety.

In Connecticut, there are specific rules about using an IID:

  • The device prevents the engine from starting if it detects a BAC of .025 or higher, though this threshold may be lower for drivers under 21.
  • All vehicles you own and operate must have an IID installed.
  • You must bring the device to a certified installer every 25 to 30 days for calibration.
  • Failing to calibrate the device can lead to another license suspension.
  • Tampering with the device, driving without it, or having someone else take a breath test for you can also result in penalties.
  • The device sends reports to the DMV if you fail a retest or have a BAC over .05.
  • There are costs involved: $175 to reinstate your license and $100 for administrative fees related to the IID.

License Suspension and Using an IID

Even if you were arrested for a DUI or OUI but haven’t been convicted, you might still be required to install an IID. In Connecticut, an arrest with a BAC of .08 or higher for adults over 21, or .02 for those under 21, can trigger this requirement.

To get your license back, you’ll need to apply for a Special Operator’s Permit. This should be done before your current suspension ends. Your license suspension typically begins 30 days after your arrest and lasts 45 days. Once that period is over, you can reinstate your license as long as an IID is installed in your vehicle.

The length of time you must use the IID depends on your age and number of offenses:

  • Under 21: 1 year for a first offense, 2 years for a second, and 3 years for a third.
  • 21 and older:
    • First Conviction: 45-day suspension, followed by at least one year of IID use.
    • Second Conviction: 45-day suspension, plus three years of IID use with restricted trips in the first year.
    • Third Conviction: Permanent license suspension, but you may appeal after three years.

Additionally, if you refuse an OUI test — whether it’s a breath, chemical, or urine test — you’ll also be required to install an IID. This rule applies to anyone charged with vehicular assault or manslaughter as well.

The IID period starts when your license is restored, not when the device is installed. However, if you receive a new suspension while using the device, the timeline resets based on your most recent incident.
