Discrimination lawsuit filed against Chicago over fire test

The Chicago Sun-Times recently published an article highlighting a new legal challenge brought by women who failed the physical abilities test used by the Chicago Fire Department (CFD). The lawsuit, filed on Friday in U.S. District Court, claims that the test is discriminatory against women and was introduced as part of a settlement over a race discrimination case involving African-American firefighters. The case, titled *Godfrey et al. v. City of Chicago*, was filed by 20 female plaintiffs on behalf of all women who took the test and did not pass. These women are already involved in two other class-action lawsuits. They were part of *Lewis et al. v. City of Chicago*, which included around 6,000 African-American applicants who challenged a 1995 firefighter entrance exam deemed racially biased by federal courts. That case was settled last year. Additionally, the Godfrey plaintiffs are also part of *Vasich v. City of Chicago*, a separate lawsuit filed last year representing women who passed the written exam but failed the physical test. Attorney Marni Willenson, who represents some of the women in the Godfrey case and leads the Vasich suit, argues that the physical test doesn’t accurately measure the skills needed for firefighting and unfairly excludes women. “We’ve been in settlement talks for over a year, yet the city chose to continue using a test we’re suing over,” Willenson said. As part of the resolution of the *Lewis* case, the city agreed to hire 111 previously excluded African-American applicants and pay up to $78 million in damages to the remaining 5,900 individuals. Both lawsuits argue that the physical test—which includes exercises like arm and leg lifts, endurance tests, hose dragging, and stair climbing—disproportionately screens out women compared to men. According to the *Godfrey* lawsuit, women made up only 2% of the more than 5,000 firefighters and emergency medical technicians in 2011. The suit seeks back pay and other remedies to address past discrimination and ensure future fairness. This latest lawsuit marks the third time the physical abilities test has been challenged in court by women.
