Discrimination lawsuit filed against Chicago over fire test

The Chicago Sun-Times recently published an article highlighting a new legal challenge against the city's physical abilities test used in hiring firefighters. The lawsuit, filed on behalf of women who failed the test, argues that the assessment is biased and disproportionately excludes women, even though it was originally implemented to address racial discrimination. The case, titled *Godfrey et al. v. City of Chicago*, was brought by 20 female plaintiffs representing all women who took the test and did not pass. These women are also part of two other ongoing class-action lawsuits. One involves over 6,000 African-American applicants who challenged a 1995 entrance exam deemed racially discriminatory by federal courts. That case was settled last year, with the city agreeing to hire 111 of the affected candidates and pay up to $78 million in damages. The same group is also involved in *Vasich v. City of Chicago*, a separate suit filed last year by women who passed the written exam but failed the physical test. Marni Willenson, one of the attorneys representing the plaintiffs, criticized the test, stating it doesn't accurately reflect the skills required for firefighting and unfairly disqualifies women. “We’ve been in settlement talks for over a year, yet the city chose to use this same test again,” she said, pointing out the irony of continuing to rely on a method that has already been called discriminatory. The physical test includes tasks such as arm and leg lifts, endurance tests, hose dragging, and stair climbing. According to the Godfrey lawsuit, these requirements result in a higher failure rate among women compared to men. In 2011, women made up just 2% of the city’s more than 5,000 firefighters and emergency medical technicians. This marks the third time the physical abilities test has faced legal scrutiny over alleged gender bias. In 2008, five women who failed a similar paramedic test filed a lawsuit, which is still pending in court.
